Heard.
The only grievance of the petitioner is that though the Agency Divisional Officer and Revenue Divisional Officer, Kothagudem, the 2nd respondent herein, passed an order dated 02.05.2015, in Senior Citizen Case No.01/2015 (LTR Case No.4/2014) by the following directions, "In view of the aforesaid evidence and observations, in the result, the petition is allowed and the entries made in the revenue records without permission, consent and knowledge of the petitioner/senior citizen, be hereby cancelled and the name of the petitioner/senior citizen Deevela Ramachandraiah's name shall be incorporated in all the revenue records, after deleting the name of respondent No.1 and his wife and further, it is directed respondent No.2 to restore the possession of the aforesaid lands to the petitioner under the cover of panchanama."
the 3rd respondent has not implemented the same, and to the extent of seeking implementation, the writ petition is filed. Learned Government Pleader has since received instructions from the 3rd respondent, wherein it was stated that the 3rd respondent gave two notices to the 4th respondent herein, but the 4th respondent did not attend the Office because of his health problem. The instructions further say that a survey needs to be conducted for implementing the order dated 02.05.2015. The stand of the 3rd respondent is clearly un-understandable, inasmuch as the order of the 2nd respondent, as extracted above, was only to correct the entries and it has nothing to do with the survey and there is no reason why the 3rd respondent is delaying the implementation of the said order.
Hence, the writ petition is disposed of directing the 3rd respondent to implement the order of the 2nd respondent, as it has stated to have attained finality, within four weeks from the date of receipt of a copy of this order. No
order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
