HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 32583 of 2017 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in trying to evict the petitioners from the land admeasuring Ac.1.36 cents in Sy.No.351/ 3, Ac.0.42 cents in Sy.No.350/ 7, Ac.0.27 cents in Sy.No.350/ 6, Ac.0.08 cents in Sy.No.350/ 4, Ac.0.10 cents in Sy.No.350/ 3, Ac.0.09 cents in Sy.No.350/ 2, Ac.0.58 cents in Sy.No.350/ 1B and Ac.0.30 cents in Sy.No.350/ 1A of Vikruthamala Revenue Village, Yerpedu Mandal, without acquiring and paying compensation as per the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehability and Resettlement Act, 2013, as illegal and arbitrary, and consequently direct the respondents to acquire the said land and to pay compensation as per the provisions of the Act 30 of 2013. 2) Though various grounds raised in the writ petition, learned counsel for the petitioners seeks a direction to the respondents to follow the procedure established under law.

3) The Government Pleader for Revenue would submit that if the petitioners are in occupation of the said land, a direction may be given to the respondents.

4) Without going into merits of the case, if the petitioners are in possession of the subject land and the respondents intend to

evict the petitioners, the respondents shall follow the procedure established under law.

5) With the above direction the writ petition is disposed of. There shall be no order as to costs.

6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
