THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Revision Case No.178 of 2016 ORDER :
This Criminal Revision Case is preferred by petitioners against the order dated 19-06-2013 in M.C.No.22 of 2012 on the file of Family Court-cum-IV Additional District & Sessions Judge at Vijayawada, whereby the learned Family Court allowed the petition in part filed by the respondent No.2 herein invoking the provisions under Section 125 Cr.P.C. and directed the petitioners herein to pay Rs.7,000/- per month as maintenance to Respondent No.2 herein.
Heard the learned counsel for petitioners, learned counsel for Respondent No.2 and the learned Public Prosecutor and perused the material available on record. Considering the facts and circumstances of the case, petitioners herein are directed to pay 50% of the arrears arising out of the order passed by the trial Court, after deducting the amounts, if any, paid before the Court concerned, on or before 15-02-2016. On such payment, the trial Court is directed to set aside the e x parte order and to hear the parties in M.C. and pass appropriate orders in accordance with law. Accordingly, the Criminal Revision Case is disposed of. Consequently, Miscellaneous Petitions pending, if any, in this revisions shall stand closed.
