O R D E R
(Per Hon'ble Sri Justice Sanjay Kumar) The petitioner is the unsuccessful applicant in O.A.No.2576 of 2016 before the Andhra Pradesh Administrative Tribunal, Hyderabad. The petitioner sought a declaration from the Tribunal by way of the said O.A. that the action of the authorities in not considering his claim for declaration of probation though he had completed the remaining part of his training as directed by the Tribunal and this Court was illegal and a consequential direction to the authorities to consider his claim for declaration of probation. By order dated 20.07.2016, the Tribunal held that the petitioner did not complete the requisite training and was therefore not entitled to declaration of probation as on that day. The O.A. was accordingly dismissed. Aggrieved thereby, the petitioner is before this Court.
Sri K.G.Krishna Murthy, learned Senior Counsel representing Sri N.Ramesh, learned counsel for the petitioner, fairly concedes that the petitioner is yet to undergo Field Operation Training for three months with Greyhounds, as mandated by the A.P. Police (Stipendiary Cadet Trainee) Rules notified under G.O.Ms.No.315, Home (Police-C) Department, dated 13.10.1999. In that view of the matter, the claim of the petitioner for declaration of his probation was premature as he could not seek such relief even before completing his training. We therefore find
no error in the Tribunal holding to this effect and dismissing the O.A.
Though the learned Senior Counsel would also seek to raise an issue with regard to completion of the training, we are of the opinion that this aspect of the matter was not gone into by the Tribunal and therefore, does not warrant consideration in this writ petition. If the petitioner has any grievance with regard to this aspect, it is left open to him to seek redressal thereof by way of independent proceedings in accordance with law. The writ petition is accordingly dismissed subject to the above observation.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
