When the matter had come up for hearing on 01.03.2016, none appeared for the appellant and there was no representation on his behalf, and therefore, the matter was posted under the caption 'for dismissal'. Even today also, when the matter has come up for hearing, none appeared for the appellant and there is no representation on his behalf. Therefore, the appellant is not evincing any interest in prosecuting the case.

Accordingly, the Second Appeal is dismissed for default. There shall be no order as to costs.

Miscellaneous Petitions, pending if any, in this Second Appeal shall stand closed.
