THE HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY I.A.No.1 of 2019 AND WRIT APPEAL No.86 of 2019 COMMON JUDGMENT: (Per the Hon'ble the Chief Justice Sri Thottathil B.Radhakrishnan) Heard the learned counsel appearing for the appellants in this Writ Appeal and the delay petition.

We have considered the substance of the appeal. It is against the order of the learned single Judge interfering with the dismissal order of the Government employee and the order of dismissal is not one which states the reasons for its making. This is the one and only ground on which the learned single Judge has allowed the Writ Petition. The learned single Judge has also recorded that neither the employee nor the Government could show to the learned single Judge any reason on the face of the dismissal order. Learned single Judge has also left open the right of the establishment to proceed against the employee in accordance with law.

That being the quality of the order of the learned single Judge, we wonder why this Writ Appeal is filed at all. We see no ground to interfere with the impugned order of the learned single Judge through this intra-Court appeal. 4.

For the aforesaid reasons, we also do not see any ground to condone the delay in the institution of the Writ Appeal.

In the result, the application filed for condonation of the delay in filing the appeal and the Writ Appeal are dismissed without prejudice to the liberty granted by the learned single Judge.

Any other miscellaneous petitions pending in this Writ Appeal, if any, shall stand closed. There shall be no order as to costs.
