THE HONB'E SRI JUSTICE CHALLA KONDANDA RAM WRIT PETITION No.11046 OF 2017 ORDER:

The writ petition is filed challenging the action of the respondents in not considering the application of the petitioner for the post Dharmakartha to the 4th respondent temple.

The grievance of the petitioner is that the 3rd respondent having issued notice under Section 15 of the A.P. Charitable and Hindu Religious Institutions & Endowments Act, 1987 (for short, "the Act"), calling for applications for appointment of trustees with respect to the 4th respondent temple, no action is being taken. It is the case of the petitioner that the petitioner pursuant to the notification issued on 08.08.2015, had made an application on 28.08.2015, though more than one and half year passed, no decision was taken so far. The learned Government Pleader for Endowments (A.P), on instructions, submits that pursuant to the notification issued, there are as many as 22 persons had applied for the post of Dharmakartha to the 4th respondent temple and a decision is yet to be taken by the respondents authorities.

In the facts and circumstances of the case and considering the fact that the notification has been issued in terms of Section 15 of the Act, the writ petition is disposed of directing the 2nd respondent to complete the process of appointing the Trust Board in accordance with law within a period of eight weeks from the date of receipt of copy of the order.

With the above direction, the writ petition is disposed of. No order as to costs.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand disposed of as infructuous.
