THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.1920 of 2018 ORDER:

Heard Mr.V.R.Reddy Kovvuri for petitioners and the learned Assistant Government Pleader for Assignment. The petitioners challenge proceedings No.

Dashapari/387/2013 dated 24.01.2014 in the present writ petition.

The petitioners filed appeal in Roc.A/301/2014 dated 13.08.2014 before the 3rd respondent challenging the order of resumption dated 24.01.2014. The petitioners invoke the jurisdiction of this Court, firstly, on the ground of lack of jurisdiction for 3rd respondent in passing proceedings impugned in the writ petition. Secondly, that the remedy of appeal is rendered ineffective for the 3rd respondent did not dispose of the appeal filed in the year 2014. The petitioners further state that the 3rd and 4th respondents are dispossessing the petitioners and allotting the subject matter of writ petition to 3rd parties.

I have perused the record and also the memorandum of appeal filed in Roc.A/301/2014 dated 13.08.2014. The writ petition is disposed of, keeping in view the pendency of appeal before 3rd respondent, by this order:

(a) The 3rd respondent considers and disposes of the Appeal No Roc.A/301/2014 dated 13.08.2014, as expeditiously as possible preferably within three (03) months from the date of receipt of copy of this order.

(b) The parties are directed to maintain status quo as regards possession and physical features etc., as on date till the appeal is heard, disposed of and order copy communicated to petitioners.

(c) The appellate authority considers all the objections raised in this behalf while disposing of the appeal. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed.
