Order:

This Writ Petition is filed for a Mandamus to declare the action of respondent No.1, in appointing respondent No.4 as the temporary fair price shop dealer of the newly created shop after bifurcation of the petitioner's shop and also the action of respondent No.3 in not disposing of the appeal filed by the petitioner against the bifurcation order, as illegal and arbitrary.

At the hearing, there is no representation for the petitioner.

The learned Government Pleader for Civil Supplies (TS) is unable to state whether the appeal filed by the petitioner has been disposed of by respondent No.3 or not.

In the light of these circumstances, respondent No.3 is directed to dispose of the appeal stated to have been filed by the petitioner, if the same has not been disposed of so far, within two months from the date of receipt of this order, after notice to the petitioner, and communicate the same to him. Till this process is completed, status quo as on today shall be continued in relation to the running of the newly created fair price shop. Subject to the above directions, the Writ Petition is disposed of.

As a sequel to disposal of the Writ Petition, WVMP.No.1425 of 209, WPMP.Nos.4563 and 4564 of 2009 are disposed of as infructuous.
