Petition filed under Sections 438 of Cr.P.C. praying that in the circumstances stated in the Grounds of Criminal Petition, the High Court may be pleased to direct the Station House Officer, Wyra Police Station, Khammam District to release the petitioner on bail in the event of his arrest in connection with Crime No. 233 of 2017 of Wyra Police Station, Khammam District.

The petition coming on for hearing, upon perusing the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri K. Srinivasa Reddy, Advocate for the Petitioner and of Public Prosecutor(TS)on behalf of RespondentState, the Court made the following ORDER :- "This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A1, in Crime No.233 of 2017 on the file of Wyra Police Station, Khammam District. The offence alleged is under Sections 498-A and 406 IPC and Sections 3 & 4 of Dowry Prohibition Act, 1961. 2.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

Counsel for the petitioner submits that the marriage between this petitioner and defacto complainant took place on 15.02.2017 and the allegation against this petitioner is that this petitioner demanded an amount of Rs.25,00,000/- towards dowry, which is highly impossible in view of the demonetisation.

This Court finds some force in the said contention. Considering the said fact and considering that the petitioner is a Government employee and he would not lose the job, this court opines that this is a fit case for granting anticipatory bail.

Accordingly, the Criminal Petition is allowed. The petitioner/ A1 is directed to surrender before the Station House Officer, Wyra Police Station, Khammam District, within 15 days from the date of this order. On such surrender, he shall be released on bail on his executing personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) each with two sureties each for a like sum each to the satisfaction of the said Station House Officer. Further, on such release, the petitioner/ A1 shall abide by the conditions mentioned under Section 438(2) Cr.P.C. as under: i) The petitioner/ A1 shall make himself available for interrogation by a police officer as and when required.

- 2 - ii) The petitioner/A1 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;

iii) The petitioner/ A1 shall not leave India without the previous permission of the Court.

As a sequel, the miscellaneous applications, if any pending, shall stand closed."
