HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.799 of 2020 ORDER:

This criminal petition is directed against the order dated 10.01.2020 passed in Crl.M.P.No.132 of 2020 in C.C.No.268 of 2018 by the learned XIII Additional Chief Metropolitan Magistrate (Mahila Court), Hyderabad.

Heard learned counsel for the petitioner/A1 and learned Additional Public Prosecutor.

The petitioner/A1 along with the other accused was charged for the offences under Sections 498-A, 406 IPC and under Sections 4 and 6 of Dowry Prohibition Act. During pendency of trial, the petitioner/A1 filed impugned application under Section 451 Cr.P.C., seeking to grant interim custody of his passport bearing No.Z2839341 to him for a limited period to enable him to perform his duties at Qatar. By order impugned, the trial Court allowed the said application with certain terms and conditions.

Learned counsel for the petitioner/A1 submits that the trial Court erred in imposing the condition of deposit of Rs.1,00,000/- on the petitioner. He prays that as the petitioner is earning small salary of Rs.30,000/- per month, the said amount may be reduced. 5.

Learned Additional Public Prosecutor submits that the trial Court has rightly imposed the conditions while granting interim custody of passport and there is no need to interfere with by this Court. A perusal of the order impugned would show that the trial Court, while granting interim custody of passport to the petitioner for a period

GSD, J CRL.P.No.799 of 2020 of six months, imposed a nominal condition to deposit a sum of Rs.1,00,000/- with one surety for a like sum and allowed the application on merit by imposing certain conditions. Therefore, this Court is of the opinion that the impugned order does not suffer from any illegality warranting interference by this Court. 7.

Hence, the Criminal Petition is dismissed.

Miscellaneous applications, if any pending in this revision, shall stand dismissed.
