HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.23683 of 2007 ORDER:

Heard Mr. D. Linga Rao for petitioner. No representation for the respondent.

2. The petitioner challenges the order of dismissal through proceedings dated 29.06.2005 as illegal, arbitrary and unconstitutional.

3. The facts and circumstances resulting in proceedings dated 29.06.2005 are not disputed by Mr. Linga Rao. The counsel fairly states that one of the grounds raised in the writ petition against the dismissal order is that Crl.A.No.857 of 2005 filed against CC No.19 of 2000 was pending and issuing dismissal order by reference to the conviction by ACB Court was unsustainable. After verifying the present status of Crl.A.No.857 of 2005, he submits that the only ground available in this behalf is also lost, as the appeal was dismissed by this court. He further submits that after the dismissal of the appeal, petitioner would have undergone sentence as well.

4. Having regard to the above circumstances, I am satisfied no ground for interference against the order impugned in the writ petition is made out. The writ petition fails and is accordingly, dismissed. No order as to costs.
