THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.18354 OF 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking to declare the high handed action of the respondents in evicting the petitioner from his land admeasuring 2540 sq.yards consisting 541 sq.yards and 1999 sq.yards respectively covered under Sy.No.164/10 of Chinamushidivada Village, Pendurthi Mandal, Visakhapatnam as illegal and arbitrary and consequently, direct the respondents not to evict the petitioner from the said land without following the due process of law.

Case of the petitioner is that he has given a representation, dated 28.02.2017, to the respondents informing about his ownership over the property in question along with relevant documents. Hence, he prays to give a direction to the respondents not to take any coercive steps against him till a decision is taken by the respondents on the said representation. 3.

Heard and perused the material available on record. 4.

Considering all the facts and circumstances of the case and the grievance of the petitioner, without going into the merits of the case, the respondents are hereby directed not to take any coercive steps against the petitioner till a decision is taken on the representation, dated 28.02.2017, filed by him. 5.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
