THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.446 OF 2015 ORDER:

This criminal revision case under Sections 397 and 401 of the Code of Criminal Procedure is filed by the petitioner/A.1 seeking to set aside the docket order, dated 07.01.2015 passed in P.R.C.No.6 of 2012 on the file of the Court of the II Additional Chief Metropolitan Magistrate, Vijayawada, whereby the learned Judge issued Non Bailable Warrant (NBW) against the petitioner/A.1. Heard and perused the material.

Learned counsel for the petitioner submits that the petitioner/A.1 has not received any summons or notice from the Court below and that he is working as a Software Engineer at West New York. He further submits that the petitioner/A.1 has not attended before the Court below because of lack of notice only and it is neither intentional nor wanton. Hence, he prays this Court to recall the NBW issued against the petitioner/A.1.

In view of the facts and circumstances, the petitioner/A.1 is directed to appear before the Court below and file an application for recalling NBW issued against him within a period of thirty days from today and on filing of such application, the Court below is directed to recall the NBW issued against the petitioner/A.1 on the same day and further the petitioner/A.1 is directed to execute a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for the like sum to the satisfaction of the said Magistrate for future appearance.

The Criminal Revision Case is accordingly disposed of. Consequently, the miscellaneous petitions filed in this revision, if any, shall stand closed. _____________________ JUSTICE RAJA ELANGO 21.07.2015 pln
