Petition filed under Sections 438 of Cr.P.C. praying that in the circumstances stated in the Grounds of Criminal Petition, the High Court may be pleased to direct the Station House Officer (S.H.O.), Gadwal Rural Police Station, Jogulamba-Gadwal District to enlarge the petitioners/accused Nos. 5, 6 & 7 herein on Bail, in the event of their arrest in relation with Crime No. 37 of 2017, on the file of the Gadwal Rural Police Station, Jogulamba - Gadwal District.
The petition coming on for hearing, upon perusing the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri Pottigari Sridhar Reddy, Advocate for the Petitioners and of Public Prosecutor(TS)on behalf of RespondentState, the Court made the following ORDER :- "This petition is filed seeking for grant of anticipatory bail to the petitioners, who are A5 to A7, in Crime No.37 of 2017 on the file of Gadwal Rural Police Station, Jogulamba District. The offence alleged is under Sections 420, 447, 468 r/w 34 IPC.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.

Counsel for the petitioners withdraws the criminal petition so far as A7 is concerned on the ground that he was already arrested. 4.
The case of the prosecution, as regards the complicity of petitioners is that they helped to A1, A2, A5 & A6 in changing the name of the person in whose favour mutation proceedings took place. 5.
Hence, considering the said fact, this court opines that this is a fit case for granting anticipatory bail.

Accordingly, the Criminal Petition is allowed. The petitioners 1 & 2/ A5 & A6 are directed to surrender before the Station House Officer, Gadwal Rural Police Station, Jogulamba District, within 15 days from the date of this order. On such surrender, they shall be released on bail on executing personal bonds for a sum of Rs.10,000/- (Rupees ten thousand only) each with two sureties each for a like sum each to the satisfaction of the said Station House Officer. Further, on such release, the petitioners 1 & 2/A5 & A6 shall abide by the conditions mentioned under Section 438(2) Cr.P.C. as under: Contd..2..
- 2 - i) The petitioners 1 & 2/A5 & A6 shall make themselves available for interrogation by a police officer as and when required. ii) The petitioners 1 & 2/ A5 & A6 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer;
iii) The petitioners 1 & 2/ A5 & A6 shall not leave India without the previous permission of the Court.
As a sequel, the miscellaneous applications, if any pending, shall stand closed."
