HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 21019 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as Fair Price Shop Dealer for Shop No. 3608 of Namapur village, Mustabad Mandal, Karimnagar District on temporary basis. On earlier occasion, a notification was issued on 10.10.2014 inviting applications for appointment as Fair Price Shop Dealer for several Fair Price Shops including the shop of the petitioner. The petitioner filed Writ Petition No. 31569 of 2014 before this Court and the same was withdrawn as the said notification was withdrawn. Thereafter, the petitioner submitted a representation on

19.3.2015 to the District Collector, Karimangar asking him to make the dealership as permanent in his favour. When the said representation was not considered by the District Collector, Karimanagar District, the present Writ Petition is filed. It is to be seen that the District Collector, Karimangar is not the competent authority to appoint Fair Price Shop Dealers. However, this type of representations cannot be entertained by the District Collector as the petitioner is only a temporary dealer. As and when the notification is issued by the competent authority inviting applications for appointment of Fair Price Shop Dealers on permanent basis, it is open for the petitioner to apply for the same.

Subject to the above, the Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
