HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.2575 of 2019 ORDER:

Challenge in this Writ Petition is to the final notice dated 07.01.2019 issued by the Tahsildar, Bantwaram Mandal, Vikarabad District, calling upon the petitioner to make known his stand duly supported by documents. The final notice mentions 02.02.2019 as the date on which the petitioner was to do so. Sri S.Harinath Reddy, learned counsel for the petitioner, would inform this Court that the enquiry was adjourned to 20.02.2019. The final notice itself indicates that the Revenue Divisional Officer, Vikarabad Division, directed the Tahsildar, Bantwaram Mandal, Vikarabad District, to conduct a de novo enquiry in the case. When the final notice is in the nature of a show-cause notice and no jurisdictional aspect has been raised in relation thereto, this Writ Petition would not lie.

Sri S.Harinath Reddy, learned counsel, would however assert that the Tahsildar, Bantwaram Mandal, Vikarabad District, has refused to look into the papers produced by the petitioner or take them on record.

As the Tahsildar, Bantwaram Mandal, Vikarabad District, himself called upon the petitioner to file his version along with supporting documents, he is bound to accept whatever documents the petitioner produces.

Making it clear that the Tahsildar, Bantwaram Mandal, Vikarabad District, shall receive the written representation of the

petitioner in response to the final notice dated 07.01.2019 along with the documents that he wishes to rely upon, the Writ Petition is disposed of.
