The relief sought for in this writ petition is to declare the action of the 2nd respondent in not passing any order in the petition filed for a direction to the 3rd respondent not to dispossess the petitioner from the lands admeasuring Ac.4.05 cents in Survey No.01 of Thimmayyapalem Village, Chejerla Mandal, SPSR Nellore District along with the appeal on 07.05.2015 aggrieved by the notice in R.C.No.B.586/2015 dated 19.04.2015 issued by the 3rd respondent as illegal and arbitrary.

Heard both sides.

In respect of the same cause of action, admittedly the petitioner has already availed the remedy of appeal before the 2nd respondent. The petitioner cannot be permitted to prosecute two parallel proceedings against the same cause of action.

Therefore, the writ petition is disposed of directing the 2nd respondent to dispose of the appeal filed by the petitioner within a period of four
