HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.1963 of 2018 ORDER:

Undisputedly, the relief in the writ petition became infructuous as pending enquiry suspension not as a measure of punishment by the impugned proceedings, dated 19.12.2017, by the 4th respondentSuperintendent, Prohibition and Excise, Anantapur, for one month from date of service stated expired as date of service is also even date of the proceedings supra.

Having regard to the above, without prejudice to the final orders to be passed in compliance with Section 31 of the A.P. Excise Act, 1968, the writ petition is closed of there is no longer survival of the interim suspension order apart from no question of extension that arises. The petitioner, by virtue of the seizure of the interim suspension, is entitled to run pending final enquiry and its result. Miscellaneous petitions pending, if any, shall stand closed. No costs.
