This transfer petition is filed seeking transfer of OP.No.132 of 2014 pending on the file of the Motor Accidents Claims Tribunalcum-III Additional District Judge, Bhimavaram, West Godavari to the City Civil Courts, Hyderabad.

The case of the petitioner is that he is working as a judicial officer at Narsapur, West Godavari District and met with an accident on 28.08.2014 while he was going to Khammam in his car and sustained severe multiple injuries and as such, he filed OP.No.132 of 2014 on the file of the Motor Accidents Claims Tribunal-cum-III Additional District Judge, Bhimavaram, West Godavari District. It is also stated that he took treatment at various hospitals at Khammam, Bhimavaram and Hyderabad. It is further stated that since he is still suffering with giddiness, emotional imbalance vertigo and mental stress and intermittent loss of memory for few minutes and getting shivering due to head injury and also injury to spinal cord, he need long term treatment, and as such he applied long leave and taking treatment at Hyderabad. It is also stated that since the doctors at Bhimavaram referred the petitioner to take treatment at Apollo Hospital, Hyderabad, he filed the present transfer petition for transferring the OP.No.132 of 2014.

Heard both sides.

In view of the above facts and circumstances which are not disputed, I am of the opinion that why the said OP should not be

transferred to the Courts at Hyderabad. In view of the same, the Transfer petition is allowed. The OP.No.132 of 2014 pending on the file of Motor Accidents Claims Tribunal-cum-III Additional District Judge, Bhimavaram is transferred to the Court of Chief Judge, City Civil Court, Hyderabad, who in turn may decide or take necessary steps for allotting the same if it is otherwise required.

As a sequel thereto, miscellaneous petitions, if any pending shall stand closed.
