This Writ Petition is filed, under Article 226 of the Constitution of India, for the following relief: "declaring the action of the 2nd respondent not disposing off Representation, dated 05.10.2015, when the 5th respondent making attempts to dispose off the lands in an extent of Ac.35-33 Cents in R.S.No.1102/2, 1141/1, 1143/2, 1144/2, 1158, 1159/2, 1176/2, 1185/2 and 1187/2 situated at Buttaigudem Village & Mandal of West Godavari District, is illegal, arbitrary and consequently direct the 2nd respondent to dispose off the Representation Dated 05.10.2015."

Heard learned counsel for the petitioners and the learned Government Pleader appearing for respondent Nos.1 to 4. 3.

In the present Writ Petition, the petitioners herein are disputing the right of respondent No.5 in receiving the compensation amount in respect of the subject properties. It is submitted by learned Government Pleader, on instructions, that the Award has not yet been passed in respect of the subject properties and it is open to the petitioners as well as respondent No.5 to raise their claims before the authorities under Act 30 of 2013.

Having regard to the submission made by learned counsel for the petitioners and the learned Government Pleader for respondent Nos.1 to 4, this Court is of the considered opinion that ends of justice would be served if the petitioners as well as respondent No.5 are permitted to raise their claims before the

respondent authorities with regard to their right over the properties.

For the aforesaid reasons, the Writ Petition is disposed of, keeping it open to the petitioners as well as respondent No.5 to raise their respective claims before respondent No.3 and it is open to respondent No.3 to consider the same and pass appropriate orders, in accordance with law.
