O R D E R
This Contempt Case is filed alleging willful disobedience of the order dt.03.04.2018 in W.P.No.10807 of 2018. In that order, this Court had directed the respondents herein to ensure that respondents 4 and 5 in the Writ Petition leave 5 feet set back between the petitioner's property and the property of respondents 4 and 5. 2.
The Contempt Case is filed by the petitioner alleging that this order has been violated. So, this Court had appointed an Advocate Commissioner to visit the site and submit his report and the Advocate Commissioner accordingly visited the site on 16.11.2019 and filed his report. In the said report, he has stated that there is a gap of more than 5 feet (para 5 of the report) between the properties of the petitioner and respondents 4 and 5 in the Writ Petition. 3.
In this view of the matter, I do not see any reason to punish the respondents for contempt.
