THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 25405 of 2015 ORDER:

The petitioner is a fair price shop dealer of Shop No.32 of Lingannapalem Village, Kondapuram Mandal, S.P.S.R.Nellore District. When the stock was not supplied to the petitioner, the petitioner filed WP.No.11600 of 2015 and the said writ petition was disposed of on 21.04.2015 directing the respondents to supply the essential commodities to the petitioner. Even after informing to the respondents on 22.04.2015 with regard to the said order, the respondents have not complied with the same. However, an order of suspension dated 30.03.2015 was communicated to the petitioner and challenging the same, the petitioner preferred an appeal on 07.07.2015. The Joint Collector passed an order on 07.07.

2015 while rejecting the application for stay directed the 3rd respondent to pass final order within four weeks from the date of receipt of the said order. The present writ petition is filed challenging the order of suspension dated 30.03.2015. In view of the pendency of the proceedings before the 3rd respondent and in view of the order passed by the 2nd respondent on 07.07.2015, this Court is not inclined to interfere with the enquiry process at this stage. However, the 3rd respondent is directed to conduct an enquiry by giving due opportunity to the petitioner and pass final orders thereon within a period of thirty days from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
