THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.2435 OF 2019 ORDER:

The grievance of the petitioners is that the State of Telangana is not passing appropriate orders upon their representation dated 05.12.2018 whereby they sought permission under Section 197 (b) Cr.P.C. to prosecute the Tahsildar, Gandimaisamma Dundigal Mandal, Medchal-Malkajgiri District, for the alleged offences committed by him while discharging his official duty. This representation was made by the petitioners to the Principal Secretary, Revenue Department, Government of Telangana.

As the statutory provision requires previous sanction from the State Government, as the Tahsildar is an employee of the State, it is not open to the sanctioning authority to receive such a representation and remain silent.

The Writ Petition is accordingly disposed of directing the Principal Secretary, Revenue Department, Government of Telangana, to take necessary action, as deemed fit, upon the petitioners' representation dated 05.12.2018 expeditiously and in any event, not later than eight weeks from the date of receipt of a copy of this order, be it from whatever source.

Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
