HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.14473 of 2014 ORDER :

This Criminal Petition is filed by the Petitioners/ accused Nos.2 to 5 since accused No.1 died on 06.03.2014 under Section 482 Cr.P.C seeking to quash the Crime No.6 of 2014 of P.S CID, Hyderabad registered for the offences punishable under Sections 420, 506 IPC and Section 3 (1) (v) (x) of SC/ST (POA) Act, 1989 against petitioners.

2) Heard learned counsel for the petitioners/ accused Nos.2 to 5 and 1st respondent-State represented by learned Public Prosecutor before admission. Perused the material on record including the interim order dated 14.08.2015 not to arrest the petitioners/ accused Nos.2 to 5 for a period of five weeks while directing investigation shall go on.

3) As the material falls short for this Court to admit the Criminal Petition filed under Section 482 Cr.P.C to quash the FIR proceedings but for to the entitlement of concession of regular bail, the Criminal Petition is disposed of giving liberty to petitioners to surrender before the learned Magistrate concerned with affidavit to surrender and move for regular bail with notice to special public prosecutor concerned on the same day. In such an event, the learned Special Judge shall grant bail with necessary conditions on the same day.

Needless to say, at post bail stage, pending investigation their presence before the Court concerned can be dispensed with. Further remedies are left open to them, in the event of police filing final report and after taking cognizance by the learned Special Judge for committal or otherwise.
