The present writ petition is filed to declare the action of the 4th respondent-Station House Officer, Shamirpet Police Station, Medchal-Malkajgiri District, in not registering a crime based on the complaint of the petitioner dated 29.01.2020, as being illegal, arbitrary and contrary to the provisions of the Criminal Procedure Code.
Heard Sri Nagula Srinivas Yadav, learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for the respondents.
The learned Assistant Government Pleader for Home, on written instructions dated 17.02.2020, while denying the averments made in the writ affidavit, submits that on receipt of the complaint from the petitioner, a case was registered in Crime No.87 of 2020 of Shamirpet Police Station on 14.02.2020 for the offence punishable under Section 447 read with Section 34 of the Indian Penal Code and the matter is being investigated into. Having regard to the fact that the case is now registered based on the complaint of the petitioner, the grievance of the petitioner in the present writ petition stands redressed, no further orders need be passed in the matter.
Accordingly, the writ petition is closed. No order as to costs. Pending miscellaneous petitions, if any, pending in this writ petition shall stand closed, in the light of this final order. ____________________ T.VINOD KUMAR, J Date: 05.03.2020 Isn
