THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.2500 OF 2020 ORDER:

The relief sought in the writ petition is as under: "For the reasons stated in the affidavit filed in support of Writ Petition, it is prayed that this Hon'ble Court may be pleased to issue a Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd Respondent in interfering with manufacturing, sale and distribution of bio-products of petitioner-Firm, viz., Ayush, Amisha, Amibha, Bond, Captain, Check, Corella, Curex, Dual, Ensure, Flash, Geomycin, Histar, Hit, Hit Plus, Kasuga, Kent, NFold, Pasidi, Porus & Sunami, by issuing Memo No.

PP.II(1)2085/2005, dated 21-01-2006 and Letter No.

PP.II(1)2085/2005, dated 21-01-2006 as being illegal, arbitrary, unconstitutional and without and further direct the 2nd respondent not to interfere with in any manner in manufacturing, sale and distribution of bio-products including from the licensed premises of the dealers/stockists under the Insecticides Act, 1968 and the Fertilizers Control (Order) Act, 1985 and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Heard learned counsel for the petitioner as well as the learned Government Pleader for Agriculture appearing for the respondents.

When the matter came up for hearing, learned counsel for the respective parties submits that the issue involved in this writ petition is squarely covered by the judgment, dated 03.11.2016, in W.A.Nos.1122 and 1136 of 2016, passed by a Division Bench of this Hon'ble Court.

In the light of the submissions made by the learned counsel for the respective parties and also in the light of the prayer sought in the writ petition, this Writ Petition is disposed of in terms of the judgment, dated 03.11.2016, in W.A.Nos.1122 and 1136 of 2016, passed by a Division Bench of this Hon'ble Court. No order as to costs.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
