B.G.Rajeswar v. The Presiding Officer, Addl.Labour Court-Cum-Addl.Indl.,Hyd.
HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.8588 of 2002 ORDER:
1.
This writ petition is filed seeking to issue a writ of Mandamus declaring the award passed in I.D.No.350 of 1999 dated 19.2.2001 by the 1st respondent in not granting attendant benefits and wages, as illegal and arbitrary, and consequently, to direct the 2nd respondent to pay back wages along with all attendant benefits.
2.
When this matter is taken up for hearing, none appeared for the petitioner.
3.
On perusal of the material available on record, it is obvious that the Labour Court while exercising power under Section 11-A of the Industrial Disputes Act, took a lenient view and set aside the punishment of removal of the petitioner and directed the respondent-management to reinstate the petitioner into service. However, the Labour Court denied back wages and other attendant benefits. After perusing the material on record, this Court is of the view that the Labour Court has not committed any illegality or irregularity in denying back wages and other attendant benefits to the petitioner. There are no merits in this writ petition.
4.
Accordingly, the Writ Petition is dismissed. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs.
