THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.689 OF 2018 ORDER:

This petition is filed by the petitioner-A4 under Section 482 Cr.P.C. to quash the proceedings in C.C.No.783 of 2017 on the file of the II Additional Junior Civil Judge-cum-XIX Metropolitan Magistrate, Kukatpally at Miyapur, Cyberabad, which took cognizance of the offences punishable under Sections 498-A IPC and 3 and 4 of Dowry Prohibition Act. 2.

Heard learned counsel for the petitioner, learned Assistant Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioner would submit that charge sheet is filed in this case. The allegations leveled against the petitioner-A4 do not constitute the offences referred supra.

In the course of submissions, it has come to the notice of this Court that charges are not framed by the trial Court. Under these circumstances, the petitioner-A4 can urge similar grounds before the trial Court and seek discharge in this case.

With the above observation, the Criminal Petition is disposed of. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
