THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE P.KESHAVA RAO WRI T PETI TI ON NO.1902 of 2018 ORDER: (per SK,J) The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue a writ of mandamus or any other appropriate writ or direction declaring the action of the respondents in not considering the application dated 03.11.2017 for settlement of the loan account under RINN SAMADHAN SCHEME (One Time Settlement) of NPA and AUCA Scheme as illegal, arbitrary and consequently direct the respondents to consider the application dated 03.11.2017 and pass such other or further orders as the Hon'ble Court feels deem fit and proper in the facts and circumstances of the case.'
Sri Maruthi Jadhav, learned counsel representing Sri B.S.Prasad, learned counsel for the State Bank of India, sought time on 24.01.2018 to get instructions. Today, he placed before us a copy of the letter dated 27.12.2017 addressed by the bank to M/s.Anantha Lakshmi Traders, Guntur, of which the petitioner is the proprietor. Therein, the bank extended the benefit of the RINN SAMADHAN Scheme (One Time Settlement of NPA and AUCA) to the said concern requiring payment of 20% on or before 25.01.2018 and the balance 75% on or before 31.03.2018. The outstanding loan dues, which aggregate to a grand total of Rs.51,88,157/-, are thereby reduced to Rs.13,05,365/-.
In the light of this communication addressed by the State Bank of India to the petitioner's proprietary concern, the grievance sought to be aired in this writ petition as to non-consideration of the application made by the petitioner's proprietary concern on 03.11.2017 for settlement of the loan account under the RINN SAMADHAN Scheme stands settled.
The writ petition therefore does not survive for further consideration and is accordingly closed.
Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
