ORDER:
This w rit petition i s filed f o r a mandamus t o set aside proceedings bearing RCC.No.941/2009, dated 30.07.2009, of respondent No.1, whereby he has suspended the
petitioner's fair price shop authorisation o f Shop No.17 of Etimoga Pallepalem Village, H/o.Chinagollapalem Village, Kruthivennu Mandal, Krishna District. This Court by order, dated 07.08.2009, granted interim suspension of the impugned order.
A t the hearing, the learned Assistant Government Pleader for Civil Supplies (AP) submitted that in pursuance of the said interim order, the petitioner's fair price shop authorisation has been restored and that in view o f the pendency o f this writ petition, respondent No.1 has not completed the enquiry and passed a final order. As the scope of this writ petition is confined to suspension of the petitioner's fair price shop authorization pending enquiry, I do not find any justification for respondent No.1 in not completing the enquiry and passing a final order.
Respondent No.1 is, therefore, directed to complete the enquiry and pass a final order, as expeditiously as possible and not later than two months from the date of receipt of a copy of this order, and take further action depending upon the nature of the order he may pass.
Subject to the above direction, the writ petition is disposed of. As a sequel to disposal of the writ petition, W.P.M.P.No.21351 of 2009 shall stand disposed of as infructuous.
