HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.15188 OF 2012 ORDER:

This Writ Petition is filed with the following prayer: "... to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus to declaring impugned action of the respondents in proceeding to dis-engage the petitioners for the purpose of engaging outsiders/new persons for the operation and maintenance works in Kothagudem Thermal Power Station V & VI stages, Paloncha Khammam though the petitioners are eligible and entitled to be continued and further action in resorting to replace the petitioners with another temporary workers as highly illegal, arbitrary and violative of Art.14 & 16 of the Constitution of India and pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case."

2. This Court has passed an interim order on 17.05.2012 directing the respondents to consider the case of the petitioners and give preference to them in view of their previous experience. Pursuant to the same, the respondents issued proceedings, dated 14.12.2012, directing the petitioners to furnish service particulars regarding place and period of engagement, wages paid by the contractors, details of agreement entered into with the contractors and the nature of duties attended by the petitioners supported by the gate passes and EPF slips. But it is stated by learned Standing Counsel for respondents that the petitioners have not complied with the same.

3. In view of the same, since it is for the petitioners to give details as required in proceedings, dated 14.12.2012, they shall provide the same within a reasonable time and on providing such information, the respondents shall consider the same and pass appropriate orders, if not already passed.

4. With the above direction, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. There shall be no order as to costs. __________________________ A. RAJASHEKER REDDY, J January 04, 2017 MD
