HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.12288 of 2007 ORDER:

The Writ Petition is filed questioning the notification dated 04.01.2007, issued under Section 4(1) of the Land Acquisition Act, 1894 (the Act), proposing to acquire petitioner's land admeasuring Ac.1.46 cents in Sy.No.346/12, Karavadi Village, Dasarajupally Village, for formation of Dumping Yard to Ongole Municipality.

While admitting the writ petition, on 14.06.2007, this Court stayed the impugned notification dated 04.01.2007. Today, when the matter came up for hearing, learned Government Pleader for Land Acquisition passed on written instructions of respondent No.1 dated 29.11.2017, wherein it is stated that respondent No.2 submitted preliminary valuation proposals, excluding the extent covered by this writ petition, which was approved by proceedings dated 25.07.2007, and award was passed on 12.09.2007. It is further stated that dumping yard has already been established in the limits of Guthikondavaripalem H/o. Koppole Village located nearer Dasarajupalli Village exempting petitioner's land of an extent of Ac.1.46 cents in Sy.No.346/12.

In view of the written instructions of respondent No.1 that dumping yard has been established exempting

petitioner's land admeasuring Ac.1.46 cents in Sy.No.346/12, no further orders need be passed in the writ petition. The Writ Petition is, accordingly, closed. However, in the circumstances, without costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
