THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.9768 of 2012 ORDER:

The grievance of the petitioner in this case was that the Station House Officer, II Town Police Station, Narasaraopet, Guntur District, registered Crime No.50 of 2012 against him on the file of the said police station pursuant to the private complaint of the second respondent.

By order dated 04.04.2012, this Court permitted the police authorities to proceed with the investigation in Crime No.50 of 2012 but directed that the petitioner should not be arrested in connection therewith till completion of the investigation. The Inspector of Police, Narasaraopet II Town Police Station, Guntur Rural District, filed a counter-affidavit stating that Crime No.50 of 2012 was registered under Sections 380, 427, 457, 464, 471 and 506 I.P.C. on the file of Narasaraopet II Town Police Station, Guntur Rural District, against the petitioner and others. He further stated that during the course of investigation, eleven witnesses had been examined but their evidence did not implicate the petitioner in any theft or trespass as alleged by the complainant/second respondent. He further stated that investigation was still ongoing.

As this Court has already protected the interest of the petitioner by directing the police authorities not to arrest him in connection with Crime No.50 of 2012 until the completion of investigation and as the investigation conducted so far has not indicated the complicity of the petitioner in any offence as alleged by the second respondent, this Court is not inclined to keep the matter pending at this stage. The writ petition is accordingly closed directing the police authorities to complete the investigation in Crime No.50 of 2012 on the file of Narasaraopet II Town Police Station, Guntur District, expeditiously and take appropriate action in the matter thereafter in accordance with law. Interim protection granted on 04.04.

continue till the completion of the investigation. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
