THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition Nos.1926 and 1929 of 2012 Common Order:

In both these Writ Petitions, the relief sought for is to declare the action of the respondents, in not considering the petitioners' case for transfer of authorization, as illegal and arbitrary; and for a consequential direction to the Revenue Divisional Officer, Siddipet to consider the petitioners' case for transfer of authorization of their fathers in terms of G.O. Ms. No. 20 dated 17.8.2011, and the earlier circulars in respect of the fair price shops. The petitioners' case, in short, is that, during the subsistence of authorization, their fathers had expired while carrying on business as fair price shop dealers; on their demise, the petitioners family has been deprived of financial support; and their applications, for transfer of fair price shop dealership, should therefore be considered by the respondents.

By way of interim relief, the petitioners sought a direction to the respondents not to make any fresh appointments in respect of the subject fair price shops pending consideration of their representations for transfer of authorization. Interim directions, as prayed for, was granted. The said interim orders continues to remain in force ever since. As the petitioners' representations, for transfer of authorization, are said to be pending consideration before the authorities concerned, ends of justice would be met if the Writ Petitions are disposed of directing the 2nd respondent to consider the petitioners' representations, for transfer of authorization, in accordance with law, with utmost expedition and in any event, within three months from the date of receipt of a copy of this order.

Revenue Divisional Officer to take further action thereafter in accordance with law.

Both the Writ Petitions are disposed of accordingly.

Miscellaneous petitions, pending, if any, shall also stand disposed of. There shall be no order as to costs.
