SMT JUSTI CE T. RAJANI CRI MI NAL PETI TI ON No.6 6 1 of 2 0 1 8 ORDER:

This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A5, in Crime No.309 of 2017 on the file of Vempalli Police Station, YSR Kadapa District. The offences alleged are under Sections 406, 409, 420, 465, 468 and 472 IPC.

2.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

3.

The case of the prosecution is that this petitioner has obtained loan by submitting fabricated and false documents. 4.

Counsel for Public Prosecutor submits that the petitioner has shown the government land as of her own land. 5.

Copy of the pass book, which is filed before this Court shows that, undisputedly the property belongs to petitioner. He also placed reliance on the record, wherein it was mentioned that the property is private property. There is involvement of the people with the help of whom the L.T loan was obtained by the petitioner. There is also an enquiry by Joint Collector and prosecution was ordered against 17 persons including this petitioner, against which the petitioner approached this Court by way of W.P. No.526 of 2018 and obtained interim order staying the suspension of the said order.

6.

Counsel for the petitioner admits that the crime was registered even prior to her obtaining the stay order. Hence, in view of the above circumstances, this Court opines that it is not a fit case for granting anticipatory bail.

7.

Accordingly, the Criminal Petition is dismissed. However, the petitioner can file a petition seeking for regular bail by surrendering herself before the court below.

The court below shall dispose of the bail application, if any filed, on merits, expeditiously, preferably on the same day, subject to the pressure of other work.

As a sequel, the miscellaneous applications, if any pending, shall stand closed.
