HONOURABLE SRI JUSTICE S.RAVI KUMAR Tr.CMP.No.27 of 2014 O R D E R:

This petition is filed to transfer H.M.O.P.No.39 of 2013 from the file of IV Additional District Judge-cum-Family Court, Kurnool to Senior Civil Judge, Nandyal, Kurnool District.

Wife filed this application on the ground of convenience and husband opposed the application on the ground that he is suffering from ailments and it is difficult for him to travel from Kurnool to Nandyal. Heard both sides. Perused the material papers filed along with the Tr.C.M.P. and also counter and medical record filed along with the counter.

Without going into the merits and demerits of the case, I feel that this petition can be disposed of by directing the trial Court to dispense with the presence of husband for each and every adjournment and also by fixing some time for disposal of the case.

Therefore, considering the convenience of the wife, Family Court O.P.No.39 of 2013 is withdrawn from IV Additional District Judge-cum-Family Court, Kurnool and transferred to Senior Civil Judge, Nandyal, Kurnool District for disposal in accordance with law and the Senior Civil

Judge, Nandyal shall dispense with the presence of the husband for each and every adjournment, however, he shall appear as and when his physical presence is necessary for disposal of the case. Further Senior Civil Judge, Nandyal shall dispose of the O.P. within six (6) months from the date of receipt of the record. Transfer Petition is ordered accordingly.

Miscellaneous petitions, if any, pending in this petition, shall stand closed.
