HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRL.P.No.2443 OF 2017 ORDER:

This petition is filed under Section 439(1)(b) of Cr.P.C. to relax the conditions imposed by the Special Judge for Andhra Pradesh Protection of Depositors of Financial Establishments Act-cum-Principal District and Sessions Judge, West Godavari at Eluru in Crl.M.P.No.1253 of 2016 in Crime No.188 of 2014 of Bhimadole Police Station, Eluru, West Godavari District, whereby the Sessions Judge by order dated 19.10.2016, while enlarging the petitioner - Bhogi Subrahmanyam @ Bhogi, on bail, directed him to furnish security for Rs.1,00,000/- with two sureties, and one of them shall be of local surety.

The petitioner was directed to report before different police stations on different dates at different places. But only difficulty for the petitioner is that it is impossible for the petitioner to report before different police stations at different places as directed by the Courts.

The petitioner also sought for relaxation of furnishing one local surety, on the ground that the petitioner already surrendered his passport before the concerned authority, as such insisting one local surety is not justified. Learned Additional Public Prosecutor fairly stated that the petitioner may be directed to report before the Additional

Superintendent of Police, CID, Vijayawada on first Saturday of every month, in all crimes pending before different Courts. Therefore, in view of the submission of learned Additional Public Prosecutor, the condition of reporting the accused before the Station House Officers concerned as directed by the Court below is hereby relaxed while directing the petitioner to report before the Additional Superintendent of Police, Vijayawada on first Saturday of every month and further the condition of one local surety is also relaxed. The other conditions shall remain unaltered.

Accordingly, the criminal petition is disposed of. Pending miscellaneous petitions in the petition, if any, shall stand closed.
