THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 1994 of 2018 O R D E R:

This writ petition is filed for the following relief: "... to issue appropriate writ or order or direction more particularly one in the nature of writ of mandamus declaring the notice issued by respondent No.4 in Ref.(D)35/2018. dated 02.01.2018, and further order of respondent No.4, dated 20.01.2018 asking the petitioner to handover the F.P. Shop No.55 to respondent No.5 as wholly illegal, arbitrary and consequently direct respondent No.4 to continue the petitioner as F.P. Shop Dealer of Shop No.55 of Rajamahendravaram Urban, East Godavari District by setting aside the notice issued by respondent No.4 in Ref.(D)35/2018, dated 02.01.2018 and the order, dated 20.01.2018...." When the matter is called, it is represented by the learned counsel for the petitioner that the issue in the present writ petition is squarely covered by the common order, dated 23.01.2018, passed by this Court in W.P.Nos.1670, 1674, 1675 and 1696 of 2018.

A perusal of the said order reflects that similarly situated persons approached this Court by way of filing the above said writ petitions and this Court disposed of the same with the following directions:

"In the instant case, there is no dispute that the petitioners were appointed on temporary basis till permanent appointments are made. Therefore, it cannot be said that there is no vested right on them. However, as of date, since no notification has been issued, the petitioners shall be continued to discharge their functions as fair price shop dealers till fresh appointments are made. The petitioners shall be entitled to seek appointment, subject to their eligibility criteria. While considering the eligibility of the petitioners, the respondent authorities shall keep in view Clause 3 (ii) of G.O.Ms.No.4,

dated 28.02.2014, wherein the legal heirs of the deceased dealers are given preference among the equal applicants. Subject to the above, the writ petitions are disposed of." Following the above said order and for the reasons recorded therein, this writ petition is also disposed of in terms thereof.

Office to enclose a copy of the common order in W.P.Nos.1670, 1674, 1675 and 1696 of 2018 to this order. Miscellaneous petitions, if any, pending shall stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:25.01.2018 kdl
