THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.19398 of 2012 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus to declare the action of the respondents in not effecting the regular pay scale attached to the regular post of Telugu Pandit Grade-II Rs.1975-4010/- w.e.f. 1977 as per the G.O.Rt.No.858 SW (El) Department, Dt.25.08.1995 from the date of initial appointment of the petitioners in 1997 onwards is illegal, arbitrary, null and void, consequently direct the respondents to pay the regular time scale for the period 1977 to 1979 with all consequential benefits." Heard, Sri S. Pradeep Kumar, learned counsel for the petitioners, learned Government Pleader for Social Welfare for respondent No.1 and learned Government Pleader for Education for respondent No.2.
When the matter is taken up, it is submitted by learned counsel for the petitioners that for redressal of the grievance of the petitioners herein, the petitioners herein will make necessary application before the respondent authorities and it is further requested that the same may be directed to be disposed of by the respondent authorities, in accordance with law, by fixing some timeframe. The said request is not opposed by learned Government Pleaders for respondents and this Court considers the said request as reasonable.
Recording the said submission and having regard to the nature of controversy, the writ petition is disposed of, without
expressing any opinion on the merits and demerits of the matter and entitlement of the petitioners, keeping it open for the petitioners herein to make necessary application before the respondent authorities for redressal of their grievance within a period of one month from the date of receipt of a copy of this order and if any such representation is made within the time stipulated the same be considered and appropriate orders be passed by the respondent authorities, in accordance with law, within a period of two (2) months thereafter.
Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
