THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.1924 of 2018 ORDER:

Grievance of the petitioner as espoused in the present Writ Petition is that she submitted a representation on 08.01.2018 followed by several other representations of her husband bringing to the notice of the District Collector and other authorities that Lingam Venkata Reddy and Bonamukkula Nagireddy are undertaking construction by dismantling the road in Survey Nos.215/E and 215/EE and the same is causing inconvenience to the other plot owners, but so far, the respondent authorities have not taken any action.

Learned Standing Counsel for the sixth respondent, on instructions, submits that the petitioner, her husband and the said Venkata Reddy have put up an unapproved layout and sold the plots to others; that the said Venkata Reddy is none other than the family member of the petitioner; that on account of internal disputes among themselves, the present Writ Petition is filed with respect to the alleged road and that the layout being unapproved, the respondents do not have any say in the matter as it is purely a civil dispute.

CKR, J W.P.No.1924 of 2018 Having considered the above submissions and considering the nature of relief which the petitioner is seeking particularly with regard to the involvement of the said Lingam Venkata Reddy and Bonamukkula Nagireddy with respect to the passage, which is a civil right basically, this Writ Petition is disposed of by giving liberty to the petitioner to agitate the same before the civil Court and seek appropriate orders against the individuals concerned or any other person.

Miscellaneous Petitions, if any pending shall stand closed. There shall be no order as to costs.
