HON'BLE SRI JUSTICE SURESH KUMAR KAIT Writ Petition No.26207 of 2015 ORDER:

On 19.08.2015, when the matter was listed before this court, the Assistant Solicitor General of India, accepted the notice and sought time to get instructions.

2. Accordingly, Mr. Namavarapu Rajeswara Rao, Standing counsel for the Central Government, sent a letter dated 10.09.2016 to the 3rd respondent by registered post, seeking instructions. Learned counsel submits that till date, he has not received any instructions.

3. Vide present writ petition, the petitioner seeks a direction to the respondents, thereby to consider the request of the petitioner dated 23.12.2013 seeking the name change in the marks memo dated 28.05.2010, vide Roll No.4177738 from " T.Sheetal" to " Tatineni Svitesh" . Neither the 3rd respondent has taken any decision on the request of the petitioner dated 23.12.2013, nor responded to the communication made by the standing counsel for the Central Government. It seems, the 3rd respondent does not bother about any of the representation nor bother about the letter sent by the Central Government standing counsel. Thus, it is clear that the 3rd respondent is wasting time of this court in not giving proper instructions to the counsel.

4. Though, such an act is creating hurdle in justice delivery system, which amounts to contempt of court. However, I hereby direct the 3rd respondent to take decision on the petitioner's representation dated 23.12.2015 within three days from the date of receipt of a copy of

this order and communicate the petitioner in writing within two days thereafter.

5. In view of the above direction, the writ petition is disposed. No order as to costs. Pending miscellaneous petitions, if any, in this writ petition, shall stand closed.

6. Needless to state that if the petitioner still aggrieved with the decision taken by the respondent mentioned above, he is at liberty to approach appropriate forum.
