THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.1885 of 2018 ORDER:
When the matter is taken up, it is submitted by the learned counsel for the petitioner so also the learned Government Pleader for Civil Supplies appearing for the respondents that the issue in the present Writ Petition is squarely covered by the common order, dated 23.01.2018, passed by this Court in Writ Petition No.1670 of 2018 and batch. Operative portion of the said order reads as under:
"In the instant case, there is no dispute that the petitioners were appointed on temporary basis till permanent appointments are made. Therefore, it cannot be said that there is no vested right on them. However, as of date, since no notification has been issued, the petitioners shall be continued to discharge their functions as fair price shop dealers till fresh appointments are made. The petitioners shall be entitled to seek appointment, subject to their eligibility criteria. While considering the eligibility of the petitioners, the respondent authorities shall keep in view Clause 3(ii) of G.O.Ms.No.4, dated 28.02.2014, wherein the legal heirs of the deceased dealers are given preference among the equal applicants." Following the above said common order and for the reasons recorded therein, this Writ Petition is also disposed of in terms thereof.
CKR, J W.P.No.1885 of 2018 Office to enclose a copy of the order, dated 23.01.2018, in Writ Petition No.1670 of 2018 and batch, to this order. Miscellaneous Petitions, if any pending shall stand closed. There shall be no order as to costs.
