Alluri Venkata Raju, S/o. Sri Suryanarayana Raju Petitioner (Accused in Cr.No.326/2017 of KPHB P.S., Cyberabad) AND State of Telangana, rep by its Public Prosecutor, High Court at Hyderabad - 500 066, through its SHO, KPHB P.S., Cyberabad.

Respondent/Complainant Petition under Section 438 of Cr.P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to grant Anticipatory Bail to the Petitioner/Accused in the event of his arrest in connection with FIR.No. 326 of 2017 of KPHB P.S., Cyberabad.

The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri N.Siva Reddy, Advocate for the Petitioner and of the Public Prosecutor (TG) for the Respondent, the Court made the following ORDER:

" This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused in Crime No.326 of 2017 on the file of the Station House Officer, KPHB Police Station, Cyberabad. The offences alleged are under Sections 420, 468 and 471 of the Indian Penal Code.

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. As per the complaint, the de facto complainant agreed to sell five dumpers to the petitioner and the petitioner paid consideration for two vehicles by way of account transfer in favour of the de facto complainant. No objection for transfer was also given by the de facto complainant. Now, the allegation is that the other three vehicles were transferred to third parties by the petitioner. Counsel for the petitioner submits that the transaction is only for purchase of two vehicles and amount was already paid for two vehicles; the RC is in the name of the complainant and hence, transfer by petitioner cannot be made. Hence, considering the above, the Criminal Petition is allowed.

Accordingly, the petitioner/accused is directed to surrender before the Station House Officer, KPHB Police Station, Cyberabad within 15 days from the date of this order. On such surrender, the petitioner/accused shall be released on bail on his executing personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the said Station House Officer. Further, on such release, the petitioner/accused shall abide by the conditions mentioned under Section 438(2) Cr.P.C.

1) The petitioner shall make himself available for interrogation by a police officer as and when required;

2) The petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer; and

3) The petitioner shall not leave India without the previous permission of the Court.
