SMT. JUSTICE T.RAJANI CRIMINAL PETITION Nos.670 AND 674 OF 2018 COMMON ORDER:

Criminal Petition No.670 of 2018 is filed by the petitioner/accused No.3 and Criminal Petition No.674 of 2018 is filed by the petitioner/accused No.1, separately, seeking for grant of anticipatory bail to them, in Crime No.8 of 2018 on the file of the Station House Officer, Humayun Nagar Police Station, Hyderabad District. The offences alleged are under Sections 307 R/w.34 I.P.C. and Section 27 of the Arms Act, 1959.

Heard the learned counsel for the petitioners, learned Public Prosecutor appearing for the respondent-State, and perused the record. 3.

Learned counsel for the petitioners submits that, insofar as these petitioners are concerned, there is absolutely no proof to show that they have participated in the offence.

On the other hand, learned Public Prosecutor contends that the confession of accused No.8 shows that a deal took place in the presence of accused Nos.1 and 3, business partners, and that as part of the deal, they gave Rs.1,00,000/- to the assailants. Learned Public Prosecutor further submits that the C.C.T.V. footage collected by the prosecution clearly shows that accused No.1 was at the scene of offence and accused No.2 was handing over the weapons to the assailants.

Hence, in the above circumstances, this Court is not inclined to grant anticipatory bail to the petitioners/accused Nos.1 and 3. Accordingly, the Criminal Petitions are dismissed.

As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
