THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10074 of 2015 ORDER:
This criminal petition is filed by the petitioners - Accused Nos.3 to 6 under Section 438 of Criminal Procedure Code seeking to grant bail in Crime No.35 of 2015 on the file of V.Kota Police Station, Chittoor District, registered for the offences punishable under Sections 498-A IPC and Sections 3 & 4 of the Dowry Prohibition Act.
Heard and perused the material available on record. The case of the prosecution is that the marriage between A1 and the de facto complainant took place in the year 2011 and they blessed with two children. Thereafter, at the instigation of the petitioners, A1 used to harass the de facto complainant to bring additional dowry and also used to beat her. Learned counsel for the petitioner submitted that the petitioners are distant relatives of A1 and they are no way connected with the family affairs of A1 and de facto complainant, and A1 was already arrested and some of the accused were also granted bail.
Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners.
In the circumstances, the petitioners - A2 to A6 are directed to surrender before the Magistrate concerned on or before 21.10.2015 and on such surrender they shall be enlarged on bail on their executing personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for the like sum to the satisfaction of the said Magistrate. The petitioners are further directed to report before the Station House Officer concerned, as and when required. Accordingly, the Criminal Petition is allowed. ______________
