THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.23111 OF 2017 ORDER:

The Writ Petition is filed challenging the action of the respondents in refusing to receive and process application for building permission in respect of petitioner's plot No.3, admeasuring 1012 square yards, or 846.03 sq.meters out of total extent of 4354 square yards, in Survey No.41, situated at Kothaguda village, Serilngampally Mandal, Ranga Reddy District, without No Objection Certificate, as illegal and arbitrary, and consequently, direct the respondents to receive and process the application of the petitioner for building permission.

The case of the petitioner is that he is the absolute owner and possessor of the abovementioned property and he applied for building construction permission to the 2nd respondent. The officials of the 2nd respondent insisted to obtain No Objection Certificate from the Tahsildar. The petitioner again submitted a detailed representation 14.06.2017 stating that NOC is not required and the application for building construction permission can be processed without the NOC. But, the respondent again refused to receive the application of the petitioner. Hence, the present Writ Petition. Heard and perused the material available on record. During the course of arguments, it is informed by the learned Standing Counsel for the 2nd respondent that the petitioner has to file the application for obtaining building construction permission through online only, and if he applies through online, the officials of the

2nd respondent would consider the same and pass appropriate orders in accordance with law.

In view of the submission of learned Standing Counsel for 2nd respondent, the Writ Petition is disposed of directing the petitioner to submit his application for building construction permission through online, and on submission of such application, the respondents shall consider the same and pass appropriate orders in accordance with law. No order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
