HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 25588 of 2003 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in regularizing the services of the petitioners w.e.f. 01.08.1994 instead of 17.08.1992, vide proceedings dated 13.09.1994, as illegal and arbitrary. A consequential direction is also sought to the respondents to regularize the services of the petitioners w.e.f. 17.08.1992. Learned counsel for the petitioners has contended that the petitioners were appointed in the respondent corporation in the year 1992, but their case was not considered for regularization of their services on par with similarly situated persons. It has been further contended that the services of the petitioners were regularized in the year 1994, whereas the services of certain individuals were regularized in the year 1992.

Learned standing counsel for the respondent corporation has contended that the persons, who were regularized in 1992, were appointed at an earlier point of time and their services were regularized when vacancies arose and no illegality has been committed by the respondent corporation in regularizing the services of the petitioners w.e.f.01.08.1994.

Having considered the submissions made by the learned counsel on either side and perused the record, this Court is of the considered view that the writ petition can be disposed of directing the

petitioners to submit a fresh representation to the respondents seeking regularization of their services on par with similarly situated persons, within two weeks from the date of receipt of a copy of this order, and upon receiving such representation, the respondents shall consider the same and pass appropriate orders, within four weeks thereafter. With the above direction, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed.
