SIVA SANKARA RAO WRIT PETITION No.38698 of 2015 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) Challenge in this writ petition was to the auction notice published on 30.10.2015 whereby the sale was scheduled to be held on 04.12.2015.

It is stated that the conditional interim order dated 27.11.2015 has been complied with. But, Sri V. Raghu, learned counsel for the respondent bank, is unable to confirm the same. Learned counsel for the respondent bank would however inform us that the sale proposed to be held on 04.12.2015 did not materialize for want of bidders.

That being so, the challenge in this writ petition as against the impugned auction notice published on 30.10.2015 is rendered purely academic and does not warrant consideration on merits. It is also brought to our notice that the sole proprietor of the petitioner proprietary concern has expired. The respondent bank shall be mindful of the same and take steps accordingly. The writ petition is accordingly dismissed leaving all issues open. Interim order dated 27.11.2015 shall stand vacated. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
