THE HONOURABLE DR. JUSTICE D.NAGARJUN I.A.No.3 OF 2022 IN/AND CRIMINAL REVISION CASE No.44 OF 2022 O R D E R:

This Criminal Revision Case is filed challenging the Judgment dated 12.01.2022 passed in Crl.A.No.735 of 2018 on the file of the learned IV Additional Metropolitan Sessions Judge, Hyderabad wherein Judgment of Conviction passed by the learned XXIV Special Magistrate, Hyderabad in C.C.No.175 of 2017 (old C.C.No.301 of 2017) and modified the sentence from Simple Imprisonment for a period of six months and to pay fine of Rs.12,00,000/-, to simple imprisonment for six months and to pay fine of Rs.06,50,000/- in default to suffer simple imprisonment for one month.

During the pendency of the present Criminal Revision Case, the parties have compromised the matter and accordingly, respondent No.1-de facto complainant filed I.A.No.3 of 2022 to permit to compound the offences and to compromise the matter, along with joint compromise memo.

This Court, vide Orders dated 06.12.2022 directed the parties to appear before the Secretary, Telangana High Court Legal

Services Committee, Hyderabad, on 08.12.2022 for their identification and also directed the Secretary to submit a report. In compliance with the said Order, the Secretary, Telangana High Court Legal Services Committee, Hyderabad, has submitted his report dated 09.12.2022. A memo is also filed stating that they have paid costs of Rs.5,000/- to the credit of the Telangana High Court Advocates Bar Association, Hyderabad as directed by this Court vide Orders dated 12.09.2022.

In the report of the Secretary, Telangana High Court Legal Services Committee, Hyderabad, it is stated that in obedience of the orders dated 06.12.2022, the petitioner and respondent No.1 have appeared before the Secretary on 09.12.2022, along with their counsel and on examination and verification of their particulars from their Aadhar Cards, they were tallied. Thus the identification of both the parties has been established. It is also stated in the report that willfully and without any coercion the parties entered into Memorandum of Compromise and they voluntarily compromised the matter. The said the report of the Secretary is placed on record.

In view the said report of the Secretary, Telangana High Court Legal Services Committee, Hyderabad and also in view

of the compromise entered between the petitioner and respondent No.1, I.A.No.3 of 2022 is allowed.

Accordingly, this Criminal Revision Case is allowed in terms of compromise. Consequently, the Judgment dated 12.01.2022 passed in Crl.A.No.735 of 2018 on the file of the learned IV Additional Metropolitan Sessions Judge, Hyderabad confirming the conviction and modifying the sentence passed in Judgment dated 20.07.2018 passed by the learned XXIV Special Magistrate, Hyderabad in C.C.No.175 of 2017 (old C.C.No.301 of 2017), are hereby set aside.

As a sequel, Miscellaneous Petitions pending in this matter, pending if any, shall stand closed.
